Terms and Conditions
These conditions apply to the exclusion of any other terms that the customer seeks to impose or incorporate, or which are implied by trade, practice or course of dealing. All terms and conditions will be in compliance with all State of Ohio and Federal rules and regulations regarding supplier terms and conditions.
A quotation given by The Glenny Glass Company shall not constitute an offer. A quotation shall only be valid for a period of sixty (60) days.
Quotation prices are based on initial information given by the customer and are subject to change based on actual order information. Any discrepancies from quotation to actual order may also result in changed delivery date estimates.
Quotation pricing is based on volumes indicated. The Glenny Glass Company reserves the right to adjust price based on actual volume ordered.
Quotation pricing is quoted to the next higher even inch. Shapes and templates, depending on glass thickness, will be quoted with 2 to 6 inches added.
All quotations are plus current quarterly surcharge and applicable tax added to invoice. Charges for set-up are based upon releases. Additional releases will result in additional set-up charges.
All edgework and fabrication are extra unless indicated on the quotation.
Energy surcharge is effective for the quarter the order is placed.
Receipt of Orders
All orders must be in writing. Faxed, emailed or signed quotation will be considered in writing. Verbal orders will not be accepted. The order shall only be deemed to be acceptable when The Glenny Glass Company issues a written acceptance of the order, at which point the contract shall come into existence.
The order constitutes an offer by the customer to purchase the goods in accordance with these conditions. The customer is responsible for ensuring that the terms of the order and applicable specifications are complete and accurate.
In the event of a cancellation request, orders which have not been entered into production may be cancelled without charge. The Glenny Glass Company will, if requested, determine if an order in production can be stopped. The customer will be liable for any charges incurred up to cancellation.
Receipt of Goods
Notification of defects considered outside specifications must be given to The Glenny Glass Company within forty-eight (48) hours of receipt of order. The Glenny Glass Company reserves the right to re-inspect prior to replacing. The Glenny Glass Company reserves the right to replace units re-inspected and deemed outside listed specifications.
The Glenny Glass Company will not assume any liability for consequential damage. The Glenny Glass Company is not liable for damage to products after receipt by customer.
Payment and Credit
Unless otherwise specified on order acknowledgement, payment terms are 1% 10 days, net 30 days. All COD orders must be paid for at time of delivery. Internal Blind orders will require a 50% down payment and 50% upon receipt of order. Past due accounts will be billed 1-1/2% per month service charge.
All order terms are subject to approval of The Glenny Glass Company Credit Department prior to acceptance. The Glenny Glass Company reserves the right to withdrawal or modify payment terms.
The Glenny Glass Company is IGCC and SGCC Certified.
The Glenny Glass Company makes no warranty, either expressed or implied, except that for a period of ten (10) years (five (5) years with muntin bars) from the date of manufacture, under normal conditions of service, material obstruction of vision resulting from film formation or dust or moisture collection between the interior surface of the insulating glass windows will not occur.
This warranty is effective only if installation is made in accordance with our specific instructions and does not apply to failure of the product on account of faulty installation or building construction or design or improper glazing procedures. This warranty shall additionally become null and void for all purposes if the insulated glass units are damaged by improper handling or if the insulating glass units are subjected to stresses resulting from localized application of heat which may cause excessive temperature differential over the glass surface or edges of the unit, or if strain is applied to the insulated glass units by movement of the building or provisions have not been made in accordance with sound practice for adequate expansion or contraction of framing members.
Purchaser hereby expressly covenants and agrees that Glenny Glass Company shall have the sole and exclusive right to determine whether or not the failure of any insulated glass product is subject to coverage under the terms and conditions of this limited warranty agreement. The Glenny Glass Company's maximum liability under the terms of this warranty shall be the delivery of replacement units F.O.B. to the shipping point nearest the place of installation. Glenny Glass Company shall bear no other expense of any type or nature including labor cost. Purchaser hereby expressly covenants and agrees that purchaser’s rights are limited to a refund of the purchase price or the furnishing of replacement product. The decision as to whether to refund monies paid or a place product shall remain solely and exclusively with Glenny Glass Company. Warranty does not apply to such replacement beyond the original ten (10) year (five (5) years with muntin bars) period applying to the original unit nor does it apply to insulated units installed in ships or boats, vehicles or commercial refrigeration.
No representative or agent of Glenny Glass Company has any authority to change or modify this limited warranty agreement in any respect nor to assume any other obligation or liability on the part of Glenny Glass Company. Both purchaser and Glenny Glass Company hereby expressly covenant and agree that the foregoing limited warranty represents the entirety of any agreement between the parties hereto.
All units are dual sealed with butyl and poly-sulfide except as indicated on booking order and all subsequent purchase orders. ICD opaci-coat is not recommended for vision areas. Resin lamination is not recommended for exposed edge application due to ¼” trim around perimeter. If fall out protection is required on spandrel glass, it must be specified at the time of quoting and an each subsequent purchase order. Unless otherwise specified, roll wave distortion will run parallel to the width of the glass. Sized on purchase orders are assumed to be width and height, as per the industry standard. Exception, any glass requiring heat treatment that is over 84” wide or less than 14” high will be rotated and will no longer have the roller wave pattern that is parallel to the width. If distortion is of concern The Glenny Glass Company recommends the viewing of a full size mock-up before the order is processed. Technical bulletins are available discussing distortion and other common issues upon request.
The Glenny Glass Company adheres to all applicable ASTM specifications. Please refer to inspection process sheets for detailed information regarding acceptable tolerances and allowances.
